Spousal
support
is the money that is sometimes required by the Court
to be paid by the spouse with greater financial
means, i.e., a larger source of income to the other
spouse. Spousal support is also commonly
referred to as "alimony."
Courts approach the issue of spousal support /
alimony on a case by case basis and do not
simply grant spousal support / alimony
in every case. If the marriage was only for a short
duration then there is a presumption against an
award of spousal support.
When reviewing a spousal support request, the
court will consider the length of the marriage, the
parties respective ages, health status, the
standard of living established during the marriage,
the occupations of both parties (as well as their
income), their vocational skills, the contributions
of both parties to the marriage, and the conduct of
the parties during the marriage.

Essentially there are five types of spousal
support (alimony):

Temporary spousal support:
typically occurs in cases where there is a
demonstrated need by one spouse and the other
has an ability to pay and it is designed to

is designed to assist the lower income earning

ability;

Permanent spousal support:
is awarded in marriages of long duration and
typically does not end until the payee spouse
dies, remarries or is in a supportive
relationship with someone else;

Bridge-the-gap spousal support:
is a type of support which is of a short
duration and is designed to assist the lower
income earning spouse until her/his post divorce
source of income begins to develop.
